Can I still claim workers comp if my employer is uninsured?

You will still be able to lodge a claim through SIRA's uninsured liability scheme. Here's how.

If your employer is uninsured, you can still make a workers compensation claim through SIRA's uninsured liability scheme. SIRA will manage your claim and ensure that you receive entitlements, such as medical expenses and wage support.

To do that, contact EML, icare's appointed claims partner, on 13 77 22 or at their website. EML will then investigate to confirm your employer's uninsured status and your eligibility for compensation, primarily by examining whether your employment contributed to the injury and if you meet the criteria under the Workers Compensation Act.

For further support, you may reach out to the Independent Review Office (IRO) at 13 94 76.

Employers who fail to have workers compensation insurance may face penalties, including fines. It is essential to report the injury and lodge the claim promptly.
