Even if you meet the legal definition of a 'worker', specific exclusions to coverage exist.
To be eligible for workers compensation in NSW, a person must meet the definition of a 'worker' under the relevant legislation. However, even with valid eligibility, there are specific exclusions to coverage:
- No compensation for injuries or death from self-harm
- No compensation if the injury is due to the worker’s serious misconduct, unless it results in death or serious disablement
- Injuries occurring under the influence of alcohol or drugs may be excluded, unless the substances were consumed involuntarily
- Compensation is not available for workers while they are imprisoned
- No compensation for injuries during professional sports
